1. About Xquip

Xquip ("we", "us", "our") operates an online marketplace connecting users ("you", "user") for the rental, sale, and hire of film and video production equipment and crew services in Australia. By creating an account or using Xquip, you agree to these Terms.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract in Australia to use Xquip. You are responsible for the accuracy of the information you provide.

3. Listings

You are responsible for the accuracy of your listings, including condition, pricing, and availability.
You must own or have full authorisation to rent or sell any gear you list.
Xquip reserves the right to remove listings that are inaccurate, fraudulent, or breach these Terms.

4. Transactions and payments

Payments are processed by our payment partner (Stripe). Xquip charges a platform fee on each completed transaction. Refunds and disputes are handled on a case-by-case basis.

5. Rentals

The renter is responsible for the equipment from pickup until return.
Renters must secure their own third-party insurance for rental gear. Xquip does not provide insurance.
Late returns may incur additional charges at the listed daily rate.

6. Crew hire

Crew engagements arranged through Xquip are independent contracts between the hirer and crew member. Xquip facilitates discovery and messaging only and is not a party to engagement contracts.

7. User conduct

No sharing of email addresses or phone numbers in public messaging before booking.
No harassment, abuse, or discrimination of other users.
No listing of stolen goods or misrepresentation of equipment condition.

8. Liability

Xquip is a marketplace platform. We are not responsible for the condition of equipment, the quality of crew work, or any damages arising from transactions between users. Users release Xquip from any claims related to dealings with other users.

9. Termination

We may suspend or terminate accounts that breach these Terms, at our sole discretion. You may close your account at any time by contacting us.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of Xquip after changes constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of Victoria, Australia.
